What is Anticipatory Bail?

Anticipatory Bail is a pre-arrest legal remedy that provides protection from arrest in non-bailable offences. Its primary objective is to safeguard an individual from unnecessary detention when there is a reasonable apprehension of arrest.

As laid down in the landmark judgment Gurbaksh Singh Sibbia vs State of Punjab (1980), the accused must demonstrate to the court that:

There is a genuine and reasonable apprehension of arrest in a non-bailable offence.

If protection is not granted, the person may face unjustified arrest.

Legal Provision: Section 438 CrPC

Under Section 438 of the Code of Criminal Procedure, 1973, an application for Anticipatory Bail can be filed before:

The Court of Session, or

The Hon’ble High Court

As a matter of practice, such applications are generally filed before the Sessions Court first.

Discretion of the Court

Courts are not bound to grant Anticipatory Bail. However, while exercising discretion, they consider several factors to ensure a balance between fair investigation and protection of individual liberty.

Key Factors Considered by Courts

Nature and gravity of the accusation and the exact role of the accused.

Antecedents of the applicant – previous convictions or imprisonment.

Possibility of absconding or fleeing from justice.

Likelihood of repeating similar offences.

Whether accusations are made to harass or humiliate the applicant.

Impact of granting bail on the investigation process.

Balance between fair investigation and prevention of harassment.

Risk of tampering with evidence or threatening witnesses.

Frivolity in prosecution and genuineness of allegations.

Available material and exact role of the accused in the alleged offence.
